TERMS CONDITIONS
These terms of offer for sale ("Terms of Offer For Sale") between Two Moustaches India
Private Limited(herein after referred to as "Two Moustaches") and the users of the Website
("You" or "Your" or "Yourself" or "User") describe, interalia, the terms of offer for sale,
purchase of goods and services through Cash, Vouchers/Coupons or otherwise on the
Website, www.twomoustaches.com.
Please read the terms of offer for sale carefully before purchasing any products or availing
any services from the website. Any purchase made by you through the website of the
products/ services shall signify your acceptance of the terms of offer for sale and your
agreement to be legally bound by the same.
In addition to the foregoing, you shall also be bound by the terms of use of the website,
terms of offer for sale issued by the management or additional terms of service which are
displayed with the selection of the product, if any ("additional terms") at the website. If there
is any conflict between the terms of offer for sale and the additional terms, the additional
terms shall take precedence in relation to that sale.
If you do not agree with the terms of offer for sale, please do not access the website for any
purchase.
1. You acknowledge that Two Moustaches has the right to change or discontinue
any Service/product/interface/offer at any time, without notice. You further
acknowledge that Two Moustaches may add or modify the procedures, modes,
processes or conditions of purchase at any time to adapt to changes that Two
Moustaches may make to the Service/product/interface/offer. You agree
thatTwo Moustaches shall not be liable to You or to any third party for any
modification, suspension or discontinuance of any aspect of the
Service/product/interface/offer.
2. Two Moustaches strives to provide You with the best prices possible on
products and services. However, prices and availability are subject to change
without notice or any consequential liability to You. Two Moustaches offers
shipping for all the products on the Website as per the company's policy, which
may be changed by the company without any notice to You. Local Taxes,
wherever applicable, is borne and paid by the Buyer/Customer/User/You and
not to be borne by Courier Company/ Two Moustaches. The price of products
offered on the Website is either equal to or lesser than the Maximum Retail
Price ("MRP") i.e., the discounted rate prescribed for those products.
3. Your shipping address, pin code will be verified with the database of Two
Moustaches before You proceed to pay for Your purchase. In the event/case
where Your order is not service able by our delivery partners, we would request
You to provide us with an alternate shipping address which we expect to have
on our partner's delivery list. In case there is any dispute regarding the
shipment of the product shipped byTwo Moustaches, we will be providing a
resolution by getting delivery arranged within 7 working days, or by refunds
(only to the extent of the invoice value).
4. You agree to indemnify, defend and hold harmless Two Moustaches from and
against any and all losses, liabilities, claims, damages, demands, costs and
expenses (including legal fees and disbursements in connection therewith and
interest charge able thereon) asserted against or incurred byTwo Moustaches
that arise out of, result from, or may be payable by virtue of, any breach of any
representation, warranty, covenant or agreement made or obligation to be
performed by You pursuant to these Terms of Offer For Sale or any Additional
Terms applicable to the purchase of products and services on the website.
5. You agree that all claims, differences and disputes arising under or
inconnection with or in relation to the Terms of Offer For Sale or any
transactions entered into on or through the Website or the relationship between
You and Two Moustaches shall be subject to the exclusive jurisdiction of the
courts at Aligarh and You hereby accede to and accept the jurisdiction of such
courts.
6. Two Moustaches may occasionally/daily/weekly/monthly send marketing
information to you, such as discount coupons, new product updates & offerings
etc. on your provided contact details i.e registered mobile number and/or
emailID. If you elect not to receive this information from Two Moustaches, you
may send an email to hello@twomoustaches.com with the subject line
UNSUBSCRIBE to remove your information from our promotional database.
7. Once an order has been confirmed, it may take up to 1-3 days to be shipped
from our warehouse. Order once handed over to the courier partner reaches
destination within 1-7 working days (varying as per pin code).
Cancellation of order
Two Moustaches reserves the right to cancel any order without any explanation for doing
so, under situation where Two Moustaches is not able to meet the requirement of the order
placed or order so placed/cancelled does not comply with the Website policy or for any
other reason. However, Two Moustaches will ensure that any communication of cancellation
of an order, so cancelled, is intimated within appropriate time to the concerned person and
any applicable refund will be made in reasonable time.
Applicable Law
This Agreement shall be governed by and interpreted and construed in accordance with the
laws of India. The place of jurisdiction shall be in Aligarh.
Risk of loss
All items purchased from the Website are made pursuant to a shipment contract. This
means that the risk of loss and title for such items pass to you upon our delivery to the
carrier.
